These Terms of Service (the “Terms”) constitute a legally binding agreement between Proofly AS and any person or entity that accesses or uses the WorkID platform. By creating an account or otherwise accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1.1 The Platform is operated by Proofly AS, a private limited company (aksjeselskap) incorporated in Norway under business registration number 937120451, having its registered office at Nedre Dalgate 56, 4013 Stavanger, Norway ("WorkID", "we", "us", or "our").
1.2 In these Terms, unless the context requires otherwise:
2.1 You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. Where you use the Platform on behalf of an organisation, you represent and warrant that you are duly authorised to bind that organisation to these Terms.
2.2 You agree to provide accurate, current, and complete information on registration and to keep such information up to date. You are responsible for maintaining the confidentiality of your authentication credentials and for all activity carried out under your account, and you must notify us without undue delay at support@workid.ai of any unauthorised use.
3.1 The Platform is a venue that connects Candidates and Employers and provides verification tools. We are not a party to, and assume no responsibility for, any employment relationship, contract, negotiation, or hiring decision between Users.
3.2 We make no representation or warranty that a Candidate will secure a position, that an Employer will fill a vacancy, or as to the accuracy, completeness, or reliability of any User Content. All decisions taken in reliance on the Platform, and the consequences thereof, are the sole responsibility of the Users concerned.
4.1 The Platform offers verification features, including identity verification (KYC), telephone verification, employer verification, and references, and generates a Trust Score reflecting the extent to which a profile has been verified.
4.2 Verification is intended to reduce, but does not eliminate, the risk of fraud, impersonation, or misrepresentation. A verified status or Trust Score constitutes an indicator only and does not constitute a warranty or guarantee by WorkID, and must not be relied upon as the sole basis for any decision.

6.1 As between you and WorkID, you retain all ownership rights in your User Content. You grant WorkID a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, reproduce, display, and otherwise use User Content to the extent necessary to operate and provide the Platform, including making a Candidate's profile available to an Employer to whom the Candidate applies.
6.2 You represent and warrant that you have all rights necessary to submit your User Content and that such content is accurate and does not infringe the rights of any third party or violate any applicable law.
7.1 Employer Users must be duly authorised to act on behalf of the organisation they represent. Employers shall use Candidate data solely for legitimate recruitment purposes, shall comply with all applicable data protection and employment laws, and shall act as an independent controller in respect of Personal Data they collect concerning Candidates and their own personnel. Employers shall not use the Platform to contact Candidates for purposes unrelated to recruitment.
8.1 Certain features, including paid plans and featured placements, are subject to payment. Payments are processed by a third-party payment services provider, and your use of paid features is additionally subject to that provider's applicable terms. Card details are handled directly by the payment provider and are not stored by WorkID.
8.2 Fees are stated at the point of purchase and, unless otherwise required by law or expressly stated, are non-refundable once the relevant paid feature has been delivered. We may amend our fees prospectively; amendments do not affect features already purchased.
9.1 The Platform, including its software, design, structure, text, graphics, and logos (excluding User Content), is owned by Proofly AS or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms or by applicable law, you shall not copy, modify, distribute, sell, licence, or create derivative works from any part of the Platform.
10.1 You may cease using the Platform and delete your account at any time.
10.2 We may suspend or terminate your access to the Platform, in whole or in part, with or without notice, where you are in breach of these Terms, where your use gives rise to risk or liability for WorkID or any third party, or where required by law. Where reasonable and lawful, we will provide prior notice.
10.3 Any provision which by its nature is intended to survive termination — including licences already granted, disclaimers, limitations of liability, indemnities, and the provisions on governing law and jurisdiction — shall survive.
11.1 The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we exclude all warranties, conditions, and representations, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that any verification result, Trust Score, or User Content is accurate or complete.
12.1 To the fullest extent permitted by applicable law, WorkID shall not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, opportunities, goodwill, or data, or for any hiring or employment outcome, arising out of or in connection with the use of, or inability to use, the Platform.
12.2 Nothing in these Terms excludes or limits any liability that may not be excluded or limited under applicable law, including liability arising from intent or gross negligence, or the mandatory statutory rights of consumers.
13.1 To the extent permitted by applicable law, you shall indemnify and hold harmless WorkID against any claims, liabilities, losses, and reasonable expenses arising out of your User Content, your use of the Platform, or your breach of these Terms or of any applicable law.
14.1 We may amend these Terms from time to time. Where an amendment is material, we will update the "Last updated" date and, where appropriate, provide notice through the Platform or by email. Your continued use of the Platform following the effective date of an amendment constitutes acceptance of the amended Terms. If you do not agree to the amended Terms, you must cease using the Platform.
15.1 These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law rules.
15.2 The courts of Norway shall have jurisdiction over any dispute arising out of or in connection with these Terms, with Stavanger District Court (Sør-Rogaland tingrett) as the agreed legal venue. Nothing in this Section deprives a consumer of the protection of mandatory provisions of the law of their country of habitual residence, including the right to bring proceedings before the courts of that country.
16.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of it. You may not assign or transfer your rights under these Terms without our prior written consent; we may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or transfer of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between the parties in respect of the Platform.
